SERVICE AGREEMENT

Terms of Use

Effective September 3, 2026

These Terms form an agreement between you and Artful Echoes when you access or purchase Ask Before You Eat. By using the service, you agree to them.

1. Eligibility

You must be at least 18, or the age of legal majority where you live, to create a paid account or make a purchase. If you use the service for another person, you remain responsible for your use and decisions.

2. Communication tool—not medical or safety advice

Ask Before You Eat is an organizational and communication tool. It does not provide medical advice, diagnose or treat a condition, inspect food, verify ingredients or restaurant practices, certify allergen safety, or determine whether food is safe for you.

Restaurant information can be incomplete or wrong, recipes and suppliers can change, and cross-contact can occur. You are responsible for speaking with restaurant staff, reviewing information, applying your own judgment, and following advice and emergency plans from qualified healthcare professionals. If you may be experiencing an emergency, use your prescribed emergency treatment and contact local emergency services immediately.

3. Accounts

Provide accurate information, protect your sign-in credentials, and notify us of suspected unauthorized access. One individual lifetime purchase is for the personal use of the account holder and may not be resold, transferred, or shared as a commercial or multi-user service.

4. Free preview and paid access

The free preview may store a dining profile only in your browser. The current founding offer is a one-time payment of US $14.99 for individual lifetime access. “Lifetime” means access for as long as Artful Echoes continues to offer and support the applicable Ask Before You Eat service; it does not guarantee operation for the purchaser’s lifetime or that every feature will remain unchanged.

Prices, taxes, currency conversion, and payment options may vary where legally permitted. PayPal processes payments under its own terms. Paid access is attached to the signed-in app account used at checkout.

5. Refunds

Our Refund Policy is part of these Terms. It provides a 14-day refund period and preserves any additional mandatory consumer rights that apply where you live. Refunded, reversed, or disputed payments may result in suspension or removal of paid access.

6. Acceptable use

Do not misuse the service, attempt unauthorized access, disrupt its operation, introduce malicious code, scrape or copy it at scale, circumvent payment or access controls, use it unlawfully, or infringe another person’s rights.

7. Ownership and license

Artful Echoes and its licensors own the service, branding, design, text, software, and other protected materials. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the service under these Terms. No ownership rights are transferred to you.

8. Third-party services

The service relies on providers such as Supabase, Vercel, PayPal, and Resend. Their services and links may be governed by separate terms. We are not responsible for third-party sites or services outside our control.

9. Availability and changes

We may maintain, improve, modify, suspend, or discontinue parts of the service. We do not promise uninterrupted or error-free availability. If we discontinue paid core access, we will honor any remedies required by applicable law.

10. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties not expressly stated here. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that restaurant information or food will be safe. Nothing in these Terms excludes a warranty or consumer guarantee that cannot legally be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Artful Echoes will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits or data, or harm arising from restaurant ingredients, preparation, cross-contact, or reliance on the service. Our total liability arising from the service will not exceed the amount you paid for it during the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited, including liability that cannot be limited for fraud, intentional misconduct, gross negligence, death or personal injury, or mandatory consumer rights.

12. Suspension and termination

We may suspend or terminate access for material violation of these Terms, fraud, unlawful activity, threats to the service, or a refunded, reversed, or disputed payment. Provisions that by their nature should survive will remain effective.

13. Governing law and local rights

Ohio law governs these Terms, without regard to conflict-of-law principles. Courts located in Ohio will have jurisdiction where legally permitted. This choice does not deprive you of mandatory consumer protections or the right to bring a claim in another forum that the law where you live requires.

14. Changes and entire agreement

We may update these Terms prospectively. We will post the new effective date and provide additional notice where required. These Terms, the Privacy Policy, and Refund Policy are the complete agreement concerning the service, except for rights that cannot be waived.
